More on IOLTA November 26, 2008

In the previous post, we reported that the Federal Deposit Insurance Corp. (FDIC) has moved to insure Interest on Lawyer Trust Accounts (IOLTA) under the Temporary Liquidity Guarantee Program (TLGP). In a time of dropping interest rates, nonprofit law firms and legal aid programs are already facing budget shortfalls due to IOLTA cuts.  This decision preserves IOLTA as a funding mechanism for these organizations. We applaud the quick and decisive action taken by the FDIC to insure IOLTA, and we applaud the rapid response of the field to this urgent matter.

As reported in this post, the American Bar Association and various allies called for the Federal Deposit Insurance Corp. (FDIC) to cover Interest on Lawyer Trust Accounts (IOLTA) under the Temporary Liquidity Guarantee Program (TLGP).  The FDIC has announced that IOLTA accounts will be covered under TLGP.  See the National Law Journal article: http://www.law.com/jsp/nlj/PubArticleNLJ.jsp?id=1202426272965.

IOLTA programs fund many legal aid programs across the country, and Equal Justice Works’ CEO David Stern joined the ABA and others in calling for this action. See the posted comments – including David’s - on the FDIC proposed changes here.

Retroactive enforcement of Proposition 8? November 21, 2008

The Supreme Court of California will decide on whether Proposition 8 is constitutional, but what about same-sex couples who already tied the knot?  Equal Justice Works Alumnus Shannon Minter says couples who married before November 5 are legally married until the court decides otherwise.  Anyone running into problems should contact the National Center for Lesbian Rights or other groups working on this issue.

Good news for all of us concerned about student debt! According to Inside Higher Ed, President-elect Obama has chosen an experienced advisor with a long history of support for student loan reforms, Bob Shireman, for his education transition team. Bob Shireman is committed to expanding educational opportunity while protecting family financial security. As a leading expert on college access and financial aid, Bob Shireman served as a congressional appointee to the Federal Advisory Committee on Student Financial Assistance, as an education policy advisor to the United States Senate and as part of President Clinton’s White House National Economic Counsel. Bob Shireman is founder of The Institute for College Access and Success and the Project on Student Debt.

ABA calls for protecting IOLTA funds November 13, 2008

Public interest attorneys could be affected by proposed FDIC rule changes to increase the liquidity in the banking system. Such changes could have a disastrous effect on Interest on Lawyer Trust Accounts (IOLTA) funding, an essential source of income for legal service organizations across the country. Read the ABA’s statement for more information.

The American Bar Association urges you to submit comments to the FDIC. The posted deadline for comment is today. This is the core message: “The Temporary Liquidity Guarantee Program (TGLP) should be expanded to provide full coverage for IOLTA accounts, regardless of the dollar amount.” Providing context for the use of IOLTA funds by your organization is helpful.

There are three ways to submit comments. Faxing a letter on letterhead is the most effective. You may use this sample letter as a guide. Send the fax to the attention of:

Public defenders sue to limit workload November 13, 2008

From this weekend’s New York Times: Citing workload, public lawyers reject new cases. Watch the video accompanying this article – “The Thin Line of Defense” – for a look inside one lawyer’s struggle to help clients as his workload becomes overwhelming.

In at least seven states, public defenders’ offices have refused or have sued to limit new cases. From the NYT: “Public defenders are notoriously overworked, and their turnover is high and their pay low. But now, in the most open revolt by public defenders in memory, many of the government-appointed lawyers say that state budget cuts and rising caseloads have pushed them to the breaking point.”

Letter to President-elect Barack Obama November 12, 2008

The Project on Student Debt sent President-elect Obama a letter congratulating him on his victory and urging him to focus on college affordability, including reducing the burden of student debt.  Equal Justice Works joins in calling upon President Obama and his new Department of Education to make every effort to inform borrowers about Income-Based Repayment and Public Service Loan Forgiveness under the College Cost Reduction and Access Act.  Public Service Loan Forgiveness will only be effective in its goal to encourage public service when participants have reliable and timely eligibility confirmation.

Momentum builds for expansion of student debt relief November 10, 2008

Following the historic election, momentum for reform of credit markets and a stronger congressional majority has set the stage for expanded student debt relief. Although the timeline for implementing President-elect Obama’s planned $4,000 refundable tuition tax credit may be affected by current budget constraints, improvements to the College Cost Reduction and Access Act’s Income-Based Repayment and Public Service Loan Forgiveness programs can be accomplished with no immediate cost to the government.
